I voted #1, too. Minions will appear in my 3.5. game on Sunday.
And the mechanics don't bother me. I will probably even go as far and use "dynamic minions", for example by throwing a mob of 50 ninja minions at my players and the last mook standing will receive an instant upgrade to normal monster status (or even elite).

I have litte problem with this, as none of my DMs are so pathetic as to do somthing like that.

It just creates some odd situations. I can live with it, and won't even house rule it, there are some scenarios where this is kinda weak. It probably is the best way to deal with a tricky rules situation.
