Actually, it can be different. For example, a Hobgoblin is CR 1/2, and has 1 HD. However, it's ECL +1. Another example is the Nixie. They are CR 1 and have 1 HD, but are ECL +3.

Challenge Rating and Hit Dice alone aren't always a good representation of overall power. There are many other things that need to be considered. If you choose to not use the ECL system, it's up to you, but you risk your NPC overshadowing your players.

Makes sense, I guess. A monster could be either more challenging or as you say, overshadowing if they got alot of skills, magical abilities, feats, or magic items. Guess you wouldn't call a kolbold a non factor if he had on +5 suit of full plate (kolbold size of course) and a +5 shotsword, and had the power attack feat.
 

That's not a very good example.

A better one would be a race that can automatically pick a lock anytime it wants to, as well as disable traps anytime it wanted to.

As a monster, that's not a very powerful ability, and wouldn't increase a CR much.

As a player, that would be insane.
