Either they are prepared to give way or they aren't - it can't be 'neither' because there isn't a third option. And yes, it's up to the DM to decide which.

I disagree. An immobile creature is evidently "neither" (and so is considered difficult terrain). This is RAW.

A confused, unobservant or impartial creature might behave similarly, neither getting out of your way nor preventing you from passing.

Agreed. Sometimes people/creatures get in the way, even if they don't mean to. I'll probably use difficult terrain for this, maybe even allow a Tumble check or Overrun, depending on the circumstances.
