I don't see any indication that Roy suggested the plan. He says convinced Hinjo to charge Belkar with manslaughter rather than murder, but not to use the high level NPCs in the cells.

Given that Rich seems to enjoy keeping 'em guessing about classes, I am instead voting for Dread Necromancer/Cleric/Mystic Theurge. But, of course, either way I am wondering why Mystic Theurge instead of True Necromancer. ;)

The MT is in the SRD. That said, she could be Clr/Wiz (or DN)/MT/TN... Let's give her three level in each (I'll just assume without checking that it's possible), makes her level 12, and a decent threat.

Maybe because one of the running gags in OotS is that proprietary WotC materials are very rarely used for fear of the lawyers coming and taking people/things away?

Hm, I was under the impression it was stated that more explicitly than what's actually in the comics, but I read 412 as a strong implication that Roy came up with the original plan as well (If Hinjo had planned the use of criminals at this point, I don't think the OotS would be too worried about Belkar not participating). The manslaughter instead of murder ploy was more of a cheap attempt to let Belkar get off scot-free so that he is available after the defense of the city for further adventures.
