"Poaching" OGC

I think "poaching" has to have an element above and beyond the reuse of OGC, even the complete reuse of OGC from a 100% OGC product (though that's pushing the limits on justifiable reuse). Mimicking trade dress would be one such element, undercutting the price another.

No offense, but who's dumb enough to make a 100% OGC product that is not an SRD?

The Modern20 PDF I recently released was 100 pages long and the only thing we protected was the name.
 


To clarify: I put E6 and Raising the Stakes out as 100% OGC because I'd like to see what people can do with them.

If someone proceeds to release the exact same .pdfs as a promotion for their website, removing my name from the credits page and putting their own name in its place, there's nothing I can do to stop them so long as my name is there in the Section 15. But that's not exactly in the spirit of the OGL, and you can't expect me to be gung-ho about it.

Now, releasing an edited, improved version with some added examples, maybe some new feats or monsters? That's not far from what I wrote but I'm personally 100% behind that kind of use.
 



If we release 100% Open products, we're "Dumb."

If we specifically exclude material from Open Content, we're releasing "Crippled" content.

Ah, the joys of game publishing.
