I see a problem in these rules. First of all your rules make it almost interresting to die, second of all, I belive that when you die, you die. Offcourse there's always the possibility to be brought back.
In the group that I play in, we have made it so, that when you come back, you always permantly loose 1 con. That way death still holds sway over the character and dangerous situations become truly dangerous. We are palyning "pen and paper", theres no chance of "saving" or "loading". When you die you die, when you return from death, it is as a weaker version than the original "you". I'm a player and i find these house rules fair... The Grayhawk campaingn has a system similar to the one you describe. Maybe you should check this out.
