As for being 5th and 7th levels...they're potent enough. That's basically 4 points of ability damage and a secondary effect for the weak one.... for multipule targets.

You could probably make a 2nd level 'touch of fatigue' that fatigues one creature if you hit them with a touch attack, or maybe just invert the ability buffs....:)
 

I can see some nasty 0 strength combos coming up with the exahustian one. Anybody know of a spell that does strength damage with no save? (if not a caster isn't likely to dodge, nor make the fort save on Ray of Enfeeblement. Assuming 10 str, this is gaurenteed kill.)

Based on the way fatigue and exhaustion are written up, it's a strength penalty, not ability score damage -- though that may only be a difference of semantics.

If I have a 10 strength, and suffer an effective penalty of -10 to strength (but haven't had the ability score lost/drained), is it different? I suspect not, but ...

There are SOME differences. For a start, I would expect that an effective penalty would persist through form changes, in the same way that an enhancement penalty would (ie - if I get strength drained, then turn into a black bear, I would expect my strength would be set to 19. However if I had a penalty to my strength, I wouldn't expect to get rid of the condition, and therefore such penalties would continue to affect me).

I would also expect that, while stat drains stack, effective penalties do not stack (ie - you don't suffer the penalties for being fatigued while you are exhausted).
 

I know a lot of people were complaining about how it seems like wizard saves are going to be hurt, especially with the new spell focus, so its nice to see some new spells without saving throws. Granted these are high level spells, but I'm all for some moderate power spells that are automatic.

Guaranteed Paralysis actually. 0 STR does not kill. The CDG does, but then, so could a Hold Monster, and this takes a spell extra (and still a save for the ray, and it is open for interpretation as well how the penalty of the ray works with the penalty of the Wave).
