Which could be construed as Evil. I jaywalked the other day, that's against the law, hence outlawry, and thus punishable by death?

I suggest you go find these things called "books" and read up on what outlawry was. It was a specific social status, not merely having committed some sort of misdemeanor or another. Your ignorance is truly astonishing.

That tone is completely uncalled for, especially the insult at the end. A simple explanation of what you meant was all that was needed.

C'mon, Dogbrain. You know the rules: no personal insults, please. Even when you disagree with someone, it's entirely possible to have a conversation without becoming rude.

If this is somehow a problem, feel free to email me.

How about instead of Detect Evil, a class bonus to Sense Motive, with a role that exceeds the DC by a certain amount or more giving them knowledge of that person's position on the Good...Neutral....Evil axis - described literarily, of course. ("You note that there is a tinge of Evil about them. It claws at them but does not own them." for Neutral Evil, for example.)

This is a huge problem in the game

Morality can be so subjective. The ability to conclusively measure someone as evil effects social organisation in dreadful ways. In the extreme this ability can completely destroy a setting.

eg. Army and 3 paladins control a city. Paladins circulate through town, mark all evil creatures & kill them. Town has no evil in it also loses much of its plot elements.

I play that a Paladin's sense works only on creatures that his\her god has marked as evil. Many small time evils might be outwayed by other elements of a person's life & thus make them appear neutral or unreadable. Motive, and other intangibles can also play a role in the god's judgment.

Undead & the enemies of the deity are much more easily discerned. For the most part, greater attention by the deity increases this sensitivity. A paladin in completely unexplored lands might receive little sense from this ability without the benefit of local prayer and worship. Conversely, an creature ritually brought before a deity's alter in a major church might be an open book.

What is Jaywalking??
Crossing an intersection against the traffic signal. Arguably, crossing where there are no crossing markers is also jaywalking, although (oddly enough) this issue has not been fully resolved in several states (including mine, New York).

Back OT: I've actually moved to the level of requiring Sense Motive checks for detect (alignment) in general. The caster gets a bonus on the check equal to caster level, and the baddies suffer a penalty based on their aura of evil. I find this works nicely, especially for the less eeeeevil sorts (nasty but not supernaturally-evil rogue-types) with high Bluff checks and low auras of evil, or for devious Saruman-types with silver tongues and Bluff-enhancing magic.
