D&D 5E Simulacrum and spell slots

I recall there being a discussion about this at some point on the old Wotc forums. If I cast Simulacrum and create a Simulacrum of myself, will it appear with the 7th level spell slot used or unused?

I don't know if there's an official ruling on the topic, but mine would be that it appears with the 7th-level slot used.

Dm call. I'd go with used.

I think most said they would go with used.

Since it has half your HP maximum, which sounds like a thing regardless of your current condition, and the Simulacrum come into the world fully rested, I would assume it has a full compliment of spells when it does.
