I make the argument that sneak attacking and critting Constructs is better, systemwise, than sneak attacking and critting undead, because, despite their lack of a Con score, Constructs get bonus HP by size category. They're still going to have less HP than a living creature with the same HD- they'll be closer, but they aren't getting THAT much from their Construct bonus HP.
