I agree that's what it looks like, it's just silly on so many levels. For starters, they royally screwed up the legalese. As I have said before, IANAL, but I think they did this so badly that they literally gave away the license for free. Let's start with what's missing: there's no long form legal contract or even Terms and Conditions listed anywhere on the website. The confusing web page, typos and all, is literally all they provide as a contract. It's beyond amateur. Most importantly, they publicly released this as open source. Frankly, I suspect they don't know what that actually means (and for any company run by adults it would be a clearly defined term in the contract), but it has some important implications. Because it's open source, we're all free to copy it and use it again. Also, it means that we are free to change it. We can literally take their name and copyright off and use it. They could have put licensing information somewhere on the website that says you have to credit TSR LLC when you use it. They could have limited it to free for non-commercial use only. But they just.. didn't. They just made it "open source". Of course, beyond that, it's even stupider. There is no commercial reason to use their service. With things like the ESRB and MPAA rating systems, you use them to gain access to distribution channels; none of that framework exists here. There's no reason you would ever pay a recurring fee for the license; with other systems you pay once for the rating and never pay again. There's no reason any RPG company would allow having a competitors name (i.e. TSR Hobbies LLC) plastered on their product as part of the rating.
