The biggest thing to remember with the employee/contract/volunteer debate is that it's largely immaterial and will not be decided on in this lawsuit. At the end of the day, it's really an issue between Justin, Dave, and maybe the IRS (or similar institution). We have heard rumors that Dave is on disability and we know that he does his other publishing work through other people (e.g. his spouse), so it's highly unlikely he would ever push the issue. Playing games like this makes Lanasa a scummy employer, but that's not really news at this point. If he lied in these court documents, he could theoretically be sued by WotC for damages caused by lying. This is extremely unlikely to happen. A criminal charge for perjury is even less likely. We also know from the conversations between Scott Griffin and Ernie that Ernie thought he was a partial owner of the DHSM. We also heard a rumor that Ernie invested $20k in the DHSM at the beginning. But Ernie now claims to just be a "volunteer", and we got this from Lanasa in his declaration: It would be interesting to find out if Ernie and/or Jeff Leason were partial owners at one point early on. But I don't think WotC want's to go down that route, as it would just make things more complicated. The reason stated explicitly is "Attached hereto as Exhibit Q is a true and correct copy of a post by “DLIMedia” that I [Dayna J. Christian of Immix Law Group for NuTSR] found while searching online forums in relation to the matters at issue in this lawsuit." I believe the implication is to show that there was confusion where the N&N version of SFNG came from, which bolsters their claim that it didn't originate with NuTSR. If viewed through the eyes of just a little paranoia, entering something like this from @DLIMedia may also be an excuse to try and subpoena or depose him later in the lawsuit. As we know from recent events, Justin is the kind of guy who would do that just to harass him, or to try and make him stop posting things.
