Others have summed up the important parts well. It doesn't matter when the stamp was placed, it matters when they sold it (last weekend), and who they were pretending to be when they sold it. And let's be clear that even NuTSR knew they couldn't use the old logo anymore, that's why they hand the design changed. What surprises me here isn't that NuTSR got caught using the old logo. I'm sure the NuMoon redesign is just a front so they can claim in court that it's different. What surprises me is that they are so sloppy they advertised it by accident. In normal lawsuits, this is part of why it costs tens or hundreds of thousands of dollars to litigate. WotC would have to pay someone for hours of work to scour the internet for the proof. Or pay to have someone visit the DHSM in person to prove it. Real private detective work. And here, NuTSR just lays out their dirty laundry in front of us, not even smart enough to notice the skid marks. The cherry on top is that this is most likely to get brought up in the damages/restitution part of the suit. Assuming WotC wins, they get to ask for NuTSR to either give back or destroy all of the "counterfeit" merch that uses WotC's marks without permission. Normally, you would assume that all the old books and vintage stuff in the DHSM would be safe. But if NuTSR is going around stamping all their inventory with the original TSR logos, they might have to hand all of it over the WotC at the end of this.
