Justin doesn't have a credible claim of perjury against him - leading to Tenkar's counsel requesting a dismissal with prejudice and full costs.2. (As has been a pattern in this case) It's just self-evident that the evidence will appear if he gets his way.3. Justin has in fact, been a model litigant... honestly.4. Justin having to spend money on legal fees in the defamation suit he started is somehow... Tenkar's fault?[ATTACH=full]341308[/ATTACH]This is an interesting approach to take given Tenkar's lawyers can:1. Point to the recent finding that Justin breached a protection order in another federal court to impeach his credibility2. Point out that so far Justin hasn't actually proved there's any defamation, so deposing the defendant is kind of pointless (it really only applies where you are showing knowledge that they were actively defaming)3. Ask them to explain why it's so important they get to depose Tenkar after the mess they made with all the other discovery and interrogatory steps.4. Point out that he should have... waited until it was actually agreed before writing to the court, and that's entirely on him.I'm guessing the judge is not going to be impressed with this.</blockquote>
