I researched the patent data base. They do not own the idea/concept. The closest was some type of construction tile company. I also searched the Trademark and copyright data bases, and their name is not registered either.

There is no copyright database for names, and copyright isn't for names. You automatically own a copyright once you publish something.

They do own the trademark, just not a federally registered one. But, that does not mean they have no trademark.

Regardless, it would be darn rude to do it without permission of the inventor. They made a great product. If they do not make it or cannot make it anymore, perhaps they would be happy to let it go to someone else or accept a small percentage of the profits. But the right thing to do is to talk to them about it first.
 

The only set that you can't easily find online for cheap now is the very first set. That one's a pain. I haven't found it anywhere for less than $35-40 or so, and I looked at a LOT of places. I refuse to pay that much for some dungeon tiles, so I just use the tiles from all of the other sets.

Sets two through the current one are all pretty widely available at various places on the Internet for about $7-9 per set, and it's not hard to get free shipping, too, if you're buying more than just one or two products. I just bought a bunch of them very recently.

I actually know what I am talking about. Sorry for what I originally wrote, it was 1:30 AM or later, and I had maybe 4 hours of sleep the night before, so I was being, um, "short". So my apologies to anyone I may have offended.

Is registration of my mark required?
No. You can establish rights in a mark based on legitimate use of the mark. However, owning a federal trademark registration on the Principal Register provides several advantages, e.g.,

* constructive notice to the public of the registrant's claim of ownership of the mark;
* a legal presumption of the registrant's ownership of the mark and the registrant's exclusive right to use the mark nationwide on or in connection with the goods and/or services listed in the registration;
* the ability to bring an action concerning the mark in federal court;

* the use of the U.S registration as a basis to obtain registration in foreign countries; and
* the ability to file the U.S. registration with the U.S. Customs Service to prevent importation of infringing foreign goods.


I may not be a lawyer, but I do read, and am able to comprehend what I read when its in english.

Why not? You put it in there, and if anyone buys it... great. If not, you can still lower the price...

Exactly. It's not the price that is ridiculous, it's the person willing to pay that price ;)
 


Tac Tiles prices make me want to hunt down the IP owners, buy the rights, and start selling new ones myself!

I think that Paizo are considering it (and Tinkered Tactics, that make the excellent Combat Tiers, also considered it but couldn't contact the IP holders).

I am pretty sure that something like them is going to get made again sooner or later, anyhow.
