The tale of a Rat Bastard DM

I have to disagree strongly here. Thats the luck/fall of the dice, and in any game they should be left where they lay.
Character death is a part of the game, and shouldn't be treated lightly nor should it be glossed over because the player is unhappy that their well rounded character has died.

Let me Explain myself better Eryx:

I believe strongly that the the dice must fall where they lie, and that luck of the die is an essential part of the game. I dont mean that DM's should fudge rolls or change the outcome of die rolls. DM's should not let PC's die unless it is the direct response to the actions of the PC (IE not in a death trap or by instant death results on a critical hit list)

Like the PC in Crimson Cats original post, the warnings where given the PC ignores them he has hung himself, DM didnt kill him he killed himself.

The PC's in my game were set up by a trusted NPC he led them into a death trap. The goal of the encounter was to display the trechery not to kill the PC's. In this situation I think it is up to the DM to allow the PC's inovative actions to change the outcome of horrible die rolls. Of course if they cant present a strategy to save the situation then death is immenent.

Combat is a different situation in that the dice must always fall where they lay and death is always around the corner. Hope this clarifies my opinion.

And on another note
