Using stone shape in combat

Not sure if this has been answered:

Can a caster use stone shape to enclose an enemy (assuming
they have enough area), say a tube from floor to a low ceiling?

Would the victim get a save?

Well, it does require the caster touch the stone to be worked so I'd allow a Reflex save and an AoO (for casting close since I don't think I'd let the "holding a charge" apply since it isn't an attack, which would prevent movement after the casting)

Ref save would be normal 10+spell level+caster stat.

Actually, you can hold the charge regardless of whether or not the spell in question constitutes an attack form, attack spell, etc. So long as it's a touch spell, you can hold the charge. Stone Shape meets that requirement.
 

I'd probably give a save to allow the victim to escape before he's trapped. I've also used the spell on the floor to send the creature down to the next level.
