Well... that's kinda not true.

There's a reason spiked chains are banned in many games.

Spiked Chain isn't "broken". Its silly, and thus why I don't allow it in my games. A regular chain weapon that did all that (perhaps lower dmg?) would be fine in my book.

Is this functionally different from taking the Improved Critical feat and using a regular Scythe? (Other than the inability to stack Keen Edge with it?).

Well yes, you can take Improved Crit with this War Scythe.

And what would that be? Is Guisarme+Armor Spikes (which does the same as a Spiked Chain and doesn't take EWP) also banned? Or Greatsword (which breaks the damage-crit-extras balance of the other martial weapons)?

Coz I can't imagine why you'd ban one of the very few exotic weapons that may be worth the feat. Except for the pure silliness of the Spiked Chain, of course. But it's really well balanced mechanically.
