XP and open content

I've been trying to find a Q&A session that I read a while ago re: what you can and can't do with the d20 license. Can't seem to find it, though.

One of the questions was along the lines of "Can I create a new core ability?" and the answer was something like "only if you can describe it in terms that don't infringe on the restriction against describing character creation"

That sound familiar to anyone? Where the heck did I read it?

From the d20 system guide. Bold emphasis is my own. So yeah, you can create a new XP chart or new XP awards. You just can't say what they DO if you want to use the d20 logo.

OK, I am confused again:
So you can give the XP chart that says something like XP X = Level Y
you can describe the class that says Level Y = Abilities Z (if you could not then all those splat books and others that have their own prestige/base classes would be in trouble)
so what is left that you can not do ?

Under the d20STL, Instructions on how to use the charts when it comes to advancing the character's level. The Player's Handbook already have that instructions.
