I think how you protect it depends on how you use it. Since it's not identifying a product or company (e.g. You're Fired Fried Chicken) I think copyright is probably right, but IANA copyright L.

If I was her, I'd ask for a cash settlement, in exchange for his right to the catch phrase in use around her area.

With her retaining the right to sell her original products locally.
