    I think it's stated under the description for immediate interrupts that the target interrupted keeps the power if it's not used, though the action itself is wasted. I could be wrong though, the system is only a few days old.

The last time I played it, over 10 years ago, I cherry picked a bunch of flaws with no actual penalties to net a bunch of extra perks, and don't even get me started on the buckets of d6's.     In terms of Improved Crit, i tend to prep Hunter's Mercy from Spell Compendium, which tends to do the job alot better (trading a standard action and a 1st level slot to prep for an attack that's an auto crit) costs me less in resources, and most of the other spells prepped are the Primal spells...
