i don't believe you would need permission. if you get your picture snapped in a public place, it's more or less free-game. unless you can demonstrate that you have been harmed in some way .(i.e. if someone is profiting from your image without permission).

and no - having sweaty, 300lb gamers drooling over your likeness (while unsettling), is not harmful.

If we were a for-profit organization, we would have to get a release form, but since this is a message board, it falls under fair use...you couldn't take her picture, put it on a t-shirt, and sell it without the release...

It does not fall under fair use.

It would not be a copyright violation anyway, since it is the photographer and not the subject who holds the copyright to the photographs he takes. (Commercial publications obtain permission to use likenesses for a variety of non-copyright reasons). As it is not a copyright violation, fair use does not apply.

Other laws may be implicated, but this situation does not have anything to do with copyright.

Uh, guys? I hate to break it to you, but I believe that the breasts have been photoshopped to have less chain than they should, else that woman is missing a nipple or two.

No, she could have perfectly normal anatomy and have her nipples adequately covered by what is shown in the picture. Most women don't have nipples that point forward, but are angled somewhat to the side. Depending on how their breasts hang, their nipples can be quite significantly splayed.

(I did a lot of anatomy study in high school and college for art classes).

Actually, no you wouldn't, not for a picture taken in a public place. See "Girls Gone Wild" videos for an example of this. IIRC, one of the girls tried to sue the producer - apparently she thought that exposing her chest was a private matter between her and the population of New Orleans . Don't believe the judge saw things her way though.

And while I love chainmail bikinis as much as the next guy (maybe a little more) Ashtal's right. Its off topic, and there's young'uns about.

Chainmail Girl

Her name is Caly (I think thats how she spells it) She married and I've met her a few times. realy nice woman. They have a calander out with a bunch of women in chainmail from various artists (its not photos of her) but she often wears chainmail or other costumes to conventions always escorted by her husband (big guy, no mess with, besides Caly's too nice to want to cause trouble with.) Anyways the costum has flesh toned fabric lining it to make it comfortable and wearable. She's got several different chainmail outfits.

she is generally recognized however as 'chainmail girl' which is what they sell the calander under.
