I believe in the faq it says that normally the defender sets the dc for the attacker to meet. And as we all know, you normally just have to make a DC, not surpass it. So in those situations the agressor wins.

equal rolls for me = struggle/stand-off - the current action ends and the next time a participant acts; they can either lose and act normally or as a move-action oppose rolls again

It says specifically under grapple (P. 156 phb 3.5) that ties to go to the person with the highest modifier, with a reroll in case of that being a tie.
