    He counts as a 4th-level character for experience purposes, so yes, he has 6,000 XP, and will need 4,000 more to gain a level. He also earns XP as though he were a 4th-level character, meaning he won't get as many points as if he were 3rd-level.

    Ah, that. No, the update was written well before the polymorph errata. I'd probably consider it an alternate form effect, but there's no official ruling that I know of.

    Dragon Magazine issue #318 contains official Oriental Adventures errata. Among many other things, hengeyokai are now humanoids with the shapechanger subtype. Probably as a consequence of this change, they also no longer have a level adjustment.

    The invocation description says that it functions the same as animate dead. Therefore, you can create up to twice your warlock level in HD of undead with each use of the invocation, and control up to 4 times your warlock level in HD of undead at any given time.

    Partial charges don't exist in 3.5, so I'd say that no, Tim won't be charged. If, however, Xaxos had readied an attack action, my understanding of the rules is that it would go off before the silence, potentially ruining Tim's concentration.
