    By far the most likely outcome of such a lawsuit is that the court would rule the license valid as written, so a lawsuit would be a waste of money.

    Yeah, concentration is the big issue with Hex. Unless you have a fiend pact then the warlock list is rather short on useful spells that don't require concentration, so if you actually want to make use of hex's long duration then you have to limit your spellcasting quite a lot.

    Kiting isn't a viable tactic in the long term. Unless you're playing adventuer's league or with a DM who strictly follows a published module, if you overdo kiting you're likely to face plenty of encounters with worg riding, longbow wielding hobgoblins.     Note that this trick won't work for most spells, since you need to spend your action to look through the familliar's eyes, but hex is a bonus action so it works perfectly :) No wonder that people are afraid witch's black cat.

    It's not overpowered. It is however a straight damage upgrade for a few character types. Nothing to worry about immediately, but it does mark the beginning of power creep in 5E.
