Only if you WANT to blame save-or-die, for whatever reason. Personally, I'm blaming monster design philosophy, or for a more general principle the assumption that underlies 3E that everything must be balanced for every occasion, which simply doesn't work in a lot of cases.

Could you specify a little more, please? What kind of encounter are you talking about? A random encounter, a planned encounter, one where the characters have a chance of knowing what's ahead or one that's getting them by surprise?

From your point of view maybe not. From where I stand? Nobody forces you to play D&D. Playing it means you bet the life of your character on the roll of the dice and his own abilities. Just because death doesn't always come parceled out in neat little packages of hit point damage doesn't mean...

The only arbitrary thing I can see is the 50 HP limit. With 3E and its increased damage potential and HP amounts, I could see an advantage in raising it to 75 HP, though. But basically every rule limiting something can be called "arbitrary" if you don't like the justification for it. :)...

Save or Die has a few sides to it (like most stuff found in D&D, usually) It's a tool for the DM. There's a good handful of creatures in myths and legends that are said to "kill with a glance". Not "sicken and weaken" but "kill". Save or Die effects like the Bodak's gaze or a Banshee's Wail are...
