Dolmenwood is OK for that (pretty friggin' great actually, IMO anyway). Warhammer's Old World could actuallybe a pretty good base, but it lacks the fairytale german thing. The tech level and feel would be very Van Helsing/Brother's Grimm which would be pretty rad.

You can't use the text or trade dress, but the mechanics themselves aren't protected (because they can't be). Anyway, this is true of every game and nothing new.
