No, the item level is just an estimate of its usefulness. Anyone can use it, but the 8th level minion might be unbalancing at level 1. It could show up in treasure as early as level 4. By level 8, it's a bog-standard item.

mmm...no sir, I don't like it. I think the "standing in midair on her cape" is a mistake, though certainly a valid interpretation. Reminds me of the Rogue, who was readying a dagger in his short stubby arm to throw at the deadly daggerfly attacking him. Artist is kinda hit and miss.

Perhaps you cut the residuum with something else, like pixie dust. Pure residuum, aside from being ludicrously expensive, is also too potent for most creatures' brains to handle. Snorting a line of pure residuum is likely to make your head explode while rainbows shoot out of your neck. Literally.
