The site has evidence showing it is him. It uses the same name he uses for all his social media (@DaveFilmsUS) and he posted both photos of himself and videos of himself which aren't posted anywhere else.

It's a ripoff of Alarums & Excursions, the original RPG zine. Lee Gold started it in 1975 and as far as I know she still publishes it to this day. Total legend in the world of gaming, kind of uncool to make something with such a confusingly similar name.

The Gygax credit is probably Ernie, with the "Jr" conveniently omitted, and his name written incorrectly. They sure are putting his name on anything they can, huh. As for Jim Holloway being credited, that is very worrying. I can't think of a legitimate reason for them to be using his work.

Once Justin realizes he can't try to cash in on someone else's legacy anymore, he's not likely to have any interest in trying to make his own games. Or any money to do it, since he's going to lose everything he owns if the lawsuit makes it to court.

Unfortunately for them, it's too late now. And hilariously, they still don't seem to understand that making a confusingly similar mark is still a violation of a trademark.

Good to know, then if they went with the statutory numbers I surmised, it would be a total of $820,000. My guess is that Wizards will ask for a judgment that's large enough to scare him away from going to court and wasting any more of their time, so they can get him to settle and get rid of...

TL;DR - scroll down for my estimation and rationale that nuTSR could be facing a judgment of about $1.2 million. A few years ago, I racked up over $100,000 in legal fees just showing the USPTO that we were using a mark in commerce after someone tried to register one of our existing trademarks...
