3.0 Persistant Spell feat question

Can the Persistant Spell feat from Tome and Blood affect spells with the range of touch?

What does the feat say? IIRC, it doesn't matter what's the range or the area, just the base duration of the spell (non instantaneous, non permanent?)...

Well it says it has to have a personal or fixed range. So does that mean a range of 60ft or touch is ok but 100ft plus 10ft/lvl isn't?

No, touch spells are not allowable with the Persistent Spell feat. Only spells that have a range of Personal, or have a fixed range (30ft line). I'd even argue that spells with ranges that increase with caster level are not allowed with this feat.

Persistent Spell [Metamagic]
You make one of your spells last all day.
Prerequisite: Extend Spell.
Benefit: A persistent spell has a duration of 24 hours. The persistent spell must have a personal or a fixed range (for example, comprehend languages or detect magic). Spells of instantaneous duration cannot be affected by this feat, nor can spells whose effect is discharged....

Some examples of spells that would work:
Bless (Range 30ft), Alter Self (Personal)

Spells that wouldn't work:
Animal Growth (Range 100ft + 10ft/lvl), Animal Messenger (Close (25 ft. + 5 ft./2 levels)), Animate Dead (Touch)

Well to me it seems like a range of touch is fixed because it doesn't change in range.

What WotC means by "fixed range"

Hi Bob,

What they mean when they use the term "fixed range" are spells which are personal spells, but which have a range in the spell description. All of the "Detect X" spells are like this, e.g.

Detect Magic
Divination
Level: Brd 0, Clr 0, Drd 0, Sor/Wiz 0
Components: V, S
Casting Time: 1 standard action
Range: 60 ft.
Area: Cone-shaped emanation
Duration: Concentration, up to 1 min./level (D)
Saving Throw: None
Spell Resistance: No

The spell has a range. That range is fixed, but it is actually a spell that affects the caster only and lets him do something over that range.

Put it this way, if the primary effect of the spell (or enabling of effect) is not personal in range, then Persistent Spell doesn't work on it.

This has been discussed to death. Touch is not fixed, only things like detect magic that have a range that says "x feet" are fixed. This has been verified and re-verified. Please trust us.

Alternatively, you could throw out this game breaking feat, and just not allow it.

Well to me it seems like a range of touch is fixed because it doesn't change in range.

But you can polymorph (or shapechange) into a creature with a different reach, or you can enlarge/reduce to the same effect. It may be still be touch, but the range isn't the same thing.

Can you make a spell that has a range of touch but that you use on yourself persistent? Probably not, eh? dang.
