D&D 3E/3.5 [3.5] Disguise question

Hi! Another problem with wording. The SRD says, "Your Disguise check result determines how good the disguise is, and it is opposed by others’ Spot check results. If you don’t draw any attention to yourself, others do not get to make Spot checks. If you come to the attention of people who are suspicious (such as a guard who is watching commoners walking through a city gate), it can be assumed that such observers are taking 10 on their Spot checks."

Later on, the skill description says, "If you are impersonating a particular individual, those who know what that person looks like get a bonus on their Spot checks according to the table below. Furthermore, they are automatically considered to be suspicious of you, so opposed checks are always called for."

Got me wondering, do the rules really mean that those who know the individual are "suspicious" in the rules sense and are always assumed to take 10, or is that just a sloppy way of saying that you always "draw their attention" and have beat their Spot checks with your Disguise check?

If the person knows the person you are disguised as, then they make opposed disguise/spot checks. If the NPC fails, he has no reason to believe you are disguised and will believe you are that person. This check means that he may spot behavior or a physical flaw in your disguise that does not resemble the person he knows. He isn't just casually observing, so he wouldn't take 10. Although, the DM could assume the NPC is casually observing and just take 10 if he wanted. Maybe the NPC is a shopkeeper who is too busy with another customer and isn't paying much attention to you.

If a person is suspicious of everyone (like a guard on watch), he can take 10. It just means he is casually looking at everyone in case he sees anything fishy.

If a person is not suspicious and you have not given them any reason to suspect you are disguised, no check is necessary.
