D&D 3E/3.5 3.5 - Sleep Arrows overpowered?

Unlike Sleep, these arrows don't have HD limit at all. So you can potentially just hit an epic level character and make him/her helpless with at least 5% chance. This reminds me Assassination from AD&D 1e....

Of course epic level is just exaggaration, since such character would be protected against simple arrows, but the point here is that with a meagre price of 132 gp's and some archery skills you have minimum 5% chance to take someone out instantly (several creatures have immunities against sleep).

Of course there are many more overpowered items then this, but how do you feel about it?

At higher levels, if you fail that saving throw, you deserve to be put to sleep. Honestly though, somebody slaps you awake that round and you are good to go. Its not that big of a deal.
 

And of course the attacker must first hit the creature in question - at higher levels with various types of protections it becomes harder and harder to do.

Lesser Planar Binding -> Nightmare -> Astral Projection and Etherealness at will as CL 20 SLA's from your new minion. No need to fear sleep arrows.

For the lactose intolerant, substitute the above with Wind Wall.
