D&D in general, and particularly 4e, is really not built for Player Character vs. Player Character combat. There are no guidelines for such a fight, so basically, it's up to your DM.

What you do with your game resources - be it actions per round, powers or action points - during a combat is your decision and your decision alone (barring mind-control effects ;) ).

It doesn't matter if you use them to attack an NPC or a PC. So yes, you can use action points. This issue can even come in in "regular" play when fighting monsters. Of course you can use an action point to use, say, Scorching Burst on a group of enemies, even if an ally is in the area, too.

The only thing you won't get without a DM ruling is experience points, since there are no rules for determining the XP value of a PC.
 






I had a Paladin that insisted on sparring with members of the party, especially when someone new joined. I found that damage is high enough and HP's low enough that the initiative roll could often determine the entire battle. Also, as a Paladin I was often at a distinct advantage. Although my mark was useless, I could heal myself as a minor action, and did off-striker damage. With the role system, some classes are just going to be innately better at pvp than others. I wouldn't make it a regular thing, if you are considering trying it.
