Are Kua-Toa part of the SRD?

I was looking at the monsters in the SRD and I noticed that Kua-Toa were not included. Can anyone point me to a comprehensive list of monsters (i.e. Beholder and Mind Flayer) that are NOT open for use by third-party publishers?

I don't think there's a list anywhere, unless it's fan generated. Kuo-toa are definitely not there, nor are beholders, mind flayers and a few others like the slaadi.

Beholder, Carrion Crawler, Displacer Beast, Githyanki, Githzerai, Kuo Toa, Mind Flayer, Slaad, Umber Hulk, Yuan Ti.

I probably missed a few.

Here's the official list of PI monsters in MM1. Looks like you just missed the gauth...
 

I only have the 3.0 MM so I'm not as familiar with all the 3.5 non-srd additions though I knew about the giths. :) I also know the sample vampires for some reason are not included, and the mindflayer might have a leveled sample (a sorcerer?). Might be some other nonstandard entries not included as well.
 

I don't think any of the monsters-with-levels are in the SRD.

Hmm, some of them are there - I see the unicorn cleric. But the mummy cleric (IIRC) isn't, and the advanced nightmare isn't, either.

They're all there- except for the leveled PI monsters, obviously. If you're used to 3.0, the Inevitables are new...
