Beguiler and Heighten Spell

first off: Thank you for your answers, tomorrow's game will be fun with my new toys to try out :)

Hijacking my own thread (i didn't want to keep on taking thread space, no offence to anyone :) :

If i use the Conceal spellcasting (Complete Scoundrel, skill trick), and the oponent that i want to cast on failes his spot check to see me cast, does this mean that he would be flat footed?

Someone who readies an action for example, who failes the spot check, cannot disrupt my casting...so since the npc is unaware, does that mean that he/she would be flatfooted against my attack (which would grant me an additional +1 for surprise spell casting with my beguiler)?

IMHO Concealed Spellcasting would NOT leave your target flat-footed if you were already in combat. That's what Feint does.

It might allow you to catch an opponent flat-footed before combat starts.
