Well, I don't know what the "practices" are that are in dispute, but if we accept Jackson wants arbitration and New Line doesn't, then we can assume that arbitration would be bad for New Line. On other news, Sir Ian McKellen implied heavily that he won't be Gandalf in a Hobbit movie that isn't directed by PJ. And Saul Zaentzszszs, president of the company that owns the rights to Tolkien's works, was pretty clear on the subject: "Peter Jackson WILL direct the Hobbit". He said that New Line is rushing to produce the movie before the rights revert to Zaentszszszs, but even if they make it, he'll just produce a new Hobbit movie afterwards that is directed by PJ.

John Rhys-Davies would be outstanding as Beorn (assuming you don't delete that segment). Get a bunch of unknown new actors to play the dwarves, and some upcoming action movie heartthrob to play Bard.
