can a monk swap between armed and unarmed without penalty

A monk Pc in my campaign carries a spear. He uses the spear's 10 foot reach to generate attacks of opportunity against creatures closing to combat with him i.e. they move through the square 10 feet away from the monk threatened by the spear and out of that threatened square to be next to the monk to attack, assuming they don't have a reach weapon or natural reach. The monk makes his attack of opportunity as they pass through this 10 foot distant threatened square into his adjacent square, fine so far. Now it's the monk's attack he can't use the spear as the creature is adjacent to him so he uses his monk unarmed attack (with his feet, headbutt etc) without dropping the spear. Am I correct in allowing this?

Yes, the monk class specifically spells out that they can attack unarmed even when their hands are full (such as by holding a longspear).
 

What about flurry?

Monk flurries an opponent. Next, a creature comes out of the shadows and runs by the monk. Can the monk hit him with a glaive? What if the actions were reversed, and a creature comes out of the shadows and the monk hits it with a glaive, later that round on the monks turn can he flurry?
 


Three points/answers.

1) Yes, a Monk who's aware and able to move always threatens the area around him or her with unarmed strkes. He can kick, headbutt, knee jab, elbow jab, or body slam, he isn't limited to just hand strikes. He can use a reach weapon to threaten from a distance, and at the very same time he still threatens his immediate vicinity with the rest of his body. This is one of the benefits of the Monk class; their whole body is a living weapon, so they're always armed and deadly as long as they can move some part of their body. Of course, they're not a very powerful class, so their relative deadliness isn't all that deadly, really (the greatsword-wielding barbarian or fighter will pretty much always outclass them moderately to substantially in damage and accuracy).

2) Monks don't normally have proficiency in spears or any other reach weapons..... Did your buddy multiclass or take the Simple Weapon Proficiency feat? Or is he just taking the -4 nonproficiency penalty on attack rolls and somehow, despite his awefully-mediocre monkish Base Attack Bonus and the irritating 'multiple ability dependency,' managing to hit enemies with his spear?

3) With the wording of Flurry of Blows (at least in 3.5; I think 3.0's description is a bit more vague), a Monk certainly can use a weapon for attacks of opportunity and still perform a Flurry of Blows that round, and may still use that weapon for AoOs after the Flurry. He or she just can't use the weapon during their full-attack action for the Flurry. Unless it's a special monk weapon, of course, the few specific weapons that are allowed for use in a Flurry.

i think your answers are spot on but its nice to have some support. FYI the monk multiclassed one level rogue early on to get spear weapon proficiency. I think the player is playing the character well, he uses the tumble skill well to good effect as well much to the envy of the more tank like paladin who has to stand and take it!

Tell him to pick up Vexing Flanker and Adaptable Flanker so he can start to flank with himself (gaining sneak attack). :)
