CE vs. N (FFA): Very Young Howling Dragon vs. Thunder Worm

Does Charley realize now that he cannot hurt Wormy at all? If so, he will withdraw ten feet back and then straight up the wall to +20ft and await the draw. If not, then full attack!

OOC Charley knows that he inflicted 5 points of damage, so if he does hurt Wormy, it will not be by much (max damage being 6, excepting critical hits).

Round 197: Charley does not manage to climb either attempt (rolled 20 and 24).
Wormy moves up to 0N15E and lashes out with a tentacle, missing.
Round 198: Charley moves back to 0N0E and tries climbing again, successfully up 10 feet, but not further (rolled 32 and 24).
Wormy tries to climb after, but fails twice.
Round 199: Charley climbs up to 0N0E30Z. Wormy cannot seem to get a grip on the wall.
Round 200: Charley stays. Wormy is getting frustrated.
Round 201: Wormy finally gets a grip, moving up to 0N10E20Z, and then to 0N5E30Z, but it is too late. A draw is declared.

First in round 202 for Chaotic Evil is an ingundi (Creature Catalog).
 

A light green lizardman moves into the arena to 60N15E. He is the size of a human, but has long, sharp claws, and a pale yellow stripe down his back. Spike will mutter in draconic, "Someone fed me after midnight." He will ready to use detect thoughts on any opponent. If the detect thoughts is a free action (I'm unsure quite honestly), then he will also ready to charm his opponent. Otherwise, he will charm the opponent the following round, assuming it has intelligence.
 

I think the Detect Thoughts is a free action, although you would have to wait two rounds after you begin detecting an area or creature before you can detect any surface thoughts.

Round 202: A short, gaunt winged human with gray, flaky skin and a sad countenance flies into the arena to 60N90N20Z, and with a wave of its hand becomes blurry.
 

OOC: Does he have to actually detect surface thoughts for the charm to work? Like ugulu, I'm not a big fan of the CC, but the description doesn't specify surface thoughts. Spike just wants to charm someone. :) If he does have to wait, though, might as well try to use it for three rounds.
 

OOC: I agree about the CC. Most of the creatures I have seen have abilities that are too ambiguous. In the charm monster ability, it says it cannot use that ability on something it has not successfully used detect thoughts on, which implies that there has to be a chance of not successfully using detect thoughts on a creature. I interpreted this to mean that this involves the saving throw for detect thoughts (although it could mean something which is immune to detect thoughts, in which case it would probably be immune to charm monster as well, anyway), which does not come into play until a creature has been in the area of the spell for two prior rounds. I am not sure this is the intent for whoever posted this creature to the CC, but that is my interpretation. If Gansk disagrees, he can overrule me. Using detect thoughts is a free action, so Spike can still do something else.
 

OOC: I agree that the intent of the description is for the ingundi to casually engage the victim for 3 rounds, read its surface thoughts, and only then can it charm the victim.
 

Spike will keep try detect thoughts then, until it succeeds or he gets injured, and go on total defense. He will speak to the dust mephit with lesser telepathy, moving his mouth and speaking apparently in the dust mephit's own tongue.

"Do not attack. I think we may have been misled and shouldn't be fighting in this arena. Give me a few moments to explain."
