D&D Miniatures -Countersong vs. Commander Effect

This rules dispute came up yesterday in D&D miniatures. A mini with the Countersong ability was killed within 6 squares of the Necromancer Lich whose Commander Effect states that any living creature destroyed creates an undead in it's place of under 5 points cost under my command.

The countersong ability says it negates enemy Commander Effects within 6 squares. I say that once the Countersong guy is destroyed, his ability is gone, and an undead is spawned. My opponent argued that the countersong blocked the undead effect until the countersonger was destroyed and gone, at which point, there is no trigger for my undead ability. Who is right & why.

Also, does Hold Monster affect humans? (In D&D miniatures)

I couldn't really say for the first part. I'd say if you're trying to be realistic, the character stops singing, drops dead, his soul departs, and then the reanimation effect takes place, but I don't play minis, so I don't know. For the second part, definitely yes. Hold monster is a much higher level spell, it effectively lets you hold anyone, not just humanoids like hold person.
