Daily class powers and levels

I was under the impression that you HAD to take a power of the new level.

You can always take a lower level power of the same type. So instead of a level 5 daily attack power, you can take a level 1 daily attack power. Or instead of a level 6 utility power, you can take a level 2 utility power.

If this is the case, is it thus possible to take twice the same power?

No. You can take each power only once PHB pg27.
 

PH 27:

7. Powers
At most levels, you gain access to a new power. You can take each power only once (you can't choose the same power multiple times).

PH 28:

Daily Attack Powers: At 1st level, choose one power from the list of 1st-level daily attack powers in your class description. You learn a new daily attack power of your level or lower at 5th level and again at 9th level.

So although you can't take the same power twice, you can take two powers of the same level. However, this will probably put you at a disadvantage, as the powers of higher levels are stronger than the powers of lower levels, unless you find some combination to exploit.

Just another quick note. Sometimes it *is* more beneficial to take a lower level power, as in the case of the warden guardian forms. Or when picking utility powers, I see something I need at a lower level, and no equivalent at the current level, so I might go for the lower level utility. My warlord has 2 level 2 utilities, and I'm thinking of picking up a level 6 utility in place of a level 10. When the current level's choices don't meet your needs, you just look below.

Especially utility powers don't always seem to fit an expected level dependent power curve because they can do such vastly different things.

I think they should allow you to take the same power more than once. It's not unbalancing, what with the "Salve of Power" (or somesuch) that lets you recuperate a daily of 5th level or lower at the cost of a surge.

Not sure I'd want to deal with cleric who has Moment of Glory x3 or a ranger with Disruptive Strike x3.

You're assuming that would be available. In our game, the DMs have pretty well made it obvious that we'll never see a Wondrous Item through level 30....

I personally feel it would unbalance the game if you could take multiples of the same power.

Imagine Grasp of the Grave covering an entire encounter area. :D

I think having more than one power would be unbalanced because, like in Dark Lord's example, each encounter and daily power assumes that it is only used once in an encounter. Powers will smaller areas of effect have greater power than those with larger areas of effect. Using a power more than once could throw this balance off.

Of course, this assumes that you care about balance. 4e is designed for balance, but apparently a lot of players don't like that, as it disallows more "interesting" situations.
