Divine Power and High HD Creatures

So what happens if a creature with high Hit Dice casts Divine Power? For my example I'll use a Famine Spirit from MM2 with 7 Cleric levels, for a total of 39 HD (32 HD + 7 class levels). Divine Power states you get the BAB of a Fighter of your total character level. So would it get:

a. BAB +39, using +1 BAB / HD
b. BAB +30, using +1 BAB for the first 20 HD and then Epic Attack Bonus for additional HD

I'm inclined to use A since creatures with more than 20 HD don't use Epic AB. But a strict reading of the rules would support B, since the BAB of a 39th level fighter is +30...

Just curious what the rest of you think. Thanks!

Check out the Epic Insights column on the Wizards' website. Andy Collins addressed this problem. After 20 levels/HD, use epic BAB progression. Divine Power is meant to give the caster the same BAB as a fighter of his level.
