Does the dream serpents Sleep gaze attack also restrict itself to creatures 4 HD and under? The serpent is CR 6, which means that its a tough encounter for a 4th level party, but more of them are supposed to challenge higher level parties. But if their gaze attack shuts off for 5th level parties and upwards, its kinda strange to make it CR 6 creature.
The sleep gaze isn't a burst anyway, so saying it's 'as the sleep spell' leaves some wiggle room.
