Trying not to defend Funksaw too much but if his message was authentic then DTRPG does seem to be sending out not only SPAM but illegal SPAM.

However, there's also this:

(1) AFFIRMATIVE CONSENT- The term `affirmative consent', when used with respect to a commercial electronic mail message, means that--

(A) the recipient expressly consented to receive the message, either in response to a clear and conspicuous request for such consent or at the recipient's own initiative; and

Everyone else managed to see the notice to avoid email, which implies it was "clear and conspicuous". Furthermore, the mail may also fall under the "relationship mail" definition, as it informs a member of a site of services to which he is entitled (more free games).

Affirmative consent however des not remove the obligation to include unsubscribe information in the email. Whether or not Funksaw consented to have email sent does not remove the legal requirement that this information be included in the email so that he can unsubcribe at any time.

I may be misreading the law, but, I believe it does, as the fact of "affirmative consent" means the message is not spam as defined by the law.

I got the same email you did, and you know why? When I signed up to give DTRPG a try with the free download, I checked the box that said they could contact me. Yes, I actually invited them to send me an email. And I read it, and I deleted it. Whop de frickin do! Wow, that was so damn hard, and I'm no worse off than I was before.

Now why don't you go crawl back under your rock unless you have something constructive to say.

Since Funksaw had his original complaint answered, and because it really does look to be out of place in publisher's forum, I'm going to go ahead and close this thread.

I do want to remind folks that we don't want to encourage bashing, no matter which way it's directed. Just as we don't take kindly for publishers to be insulted, it goes the other way, too.
