DUDE!! Where the heck is the Mind Flayer??

If I remember correctly the monsters mentioned were part of "the gentleman's agreement" back in the days. Can someone expand on this? In the first version of the SRD no monsters were included, yet publishers could use stuff from MM instead. The agreement being that publishers could use goblin or dragon but had to steer clear of any IP of WoTC (i.e. beholder).

The Gentleman's Agreement was a sort of proto-SRD. The SRD wasn't finalized when 3E came out...in fact, it took quite a while for the document to be finished. During that time, WotC drafted the Gentleman's Agreement...so named because when the SRD was finished, it was understood that the companies would switch to that...WotC was being gentlemen by letting the other companies use their stuff before the license was finished.

When it was finished, WotC decided that they wanted to keep some things closed content, since they were "quintessentially D&D" and not just d20. This included things such as deity names, NPC names, and a few monsters. If you look at the Legal section of the SRD, you can find the entire list of closed content:

The topic comes frequently. Where are the illithids/giths/whatever in the SRD? Nowhere, because they're considered unique to D&D, rather than generic fantasy creatures, and thus intellectual property of WotC.

The word "learnean" is actually no more used in revised edition, but I was just wanting a name better than "standard" to define the hydras that are neither pyro- nor cryo-. And since all hydras now works like the learnean hydras worked in non-revised 3e...

I very much believe the terms Eladrin and Guardinal are also not in the SRD.
 

Yep, indeed. Ghaele and bralani have their own entry in the SRD (they aren't grouped under Eladrin as in MM v3.5 or Celestial as in MM v3.0), and likewise for Avoral and Leonal.

However, if the subtype isn't defined in the SRD, the word itself is included in. The summon monster tables (http://www.wizards.com/d20/files/v35/SpellsS.rtf)

I think you should qualify that not being in the SRD is not the same thing as not being Open-content. The Yuan-ti are not open content AND not in the SRD. The Aboleth is...the Aboleth Mage example is not in the SRD, but I doubt that it's not open content, so much as WotC not wanting to bother putting examples of advanced creatures in the SRD (Hence no sample Celestial Lion, Aboleth Mage, Mummy with Cleric levels, and so on). After all, they want to encourage you to purchase the 3.5 MM, and that's one way to sweeten the pot.
 

wasn't there also some statement on the WotC site about not being able to kill off "name" characters without the express written consent of Hasbeen.

so does that hold true now then for the monsters too. ;)

no more killing beholders, mind flayers, yuan-ti, etc...


or did that rule only apply to the novels? :confused:

The terms tanari and baatezu were not included in the 3.0 srd, just the draft one.

Just clearing this, because I knew baatezu and tanar'ri have never been in an actual SRD.

Look... me and the McDonald's people got this little misunderstanding. See, they're McDonald's... I'm McDowell's. They got the Golden Arches, mine is the Golden Arcs. They got the Big Mac, I got the Big Mick. We both got two all-beef patties, special sauce, lettuce, cheese, pickles and onions, but their buns have sesame seeds. My buns have no seeds.
