Yes, all the XPH rules do is screw the rogue out of Evasion/Improved Evasion, which is one of the abilities that balances his d6 hit die. If suddenly a wizard can prepare half his spells as [Cold] and completely circumvent that, there are going to be a lot of dead rogues in the world.
