Epic monster feats - what am I missing?

Hi folks,

I'm trying to make sure all the new epic monsters I design have the right number of feats. (As you do.) However, comparing my stuff with that in the Epic Handbook is proving a tad confusing. I'm sure I'm missing something very obvious (and probably just need more coffee) but for the life of me I can't put my finger on it.

According to the usual 'one feat plus one more every three levels/HD' rule, something like the Shape of Fire (35 HD) should have 12 feats in total, of which up to 5 could be epic, since beyond 20 HD, you can take an epic feat or a regular one. It doesn't. It has 10 regular feats and 4 epic feats.

It's not the only culprit. The sirrush has 40 HD. This should mean 14 feats, of which 7 could be epic. Nope. It has 16 regular feats and 6 epic ones.

The Demilich has 21 hit dice. That should be 8 feats, of which 1 could be epic, right? So why does it have 12 regular feats and 4 epic?

By contrast, the Ha-Naga, with 20 HD, should have 7 feats, and does.

Either there's some mechanic going on in which some of the creature's HD are being counted as class levels, or all these extra feats are uncredited bonus feats, or I've missed something important somewhere. I'm braced to look like a clueless dork if this is the case.

If anyone has any light to shed on this, I'd be very grateful.

in 3.0, WotC was notorious for not pointing out what were bonus feats.

Also, in 3.0, the 1 feat/3 levels(HD) didn't apply to all monsters: some got at different rates, some got feats for INT mod., etc. Check out the 3.0 MM for details on that crazyness.

Of course, of course.... the Epic stuff came out during the 3.0 era. THAT is the problem.

Well, I'll just design the new beasties according to the 3.5 rules, then. This should, I hope, be sufficient to ward off the dread eye of Mr. Cooper. Thanks for the help!
