Okay:
1. what books in the freeport series are 'systemless'?

2. what books would you recommend, regardless of what system I used?

3. what books would you recommend if I was going to run a 4E game?

4. what books would you recommend if I was going to run a 3.x game?

If you wanted to start out running 4e Freeport, but needed some extra pirate-y goodness, I think Scarrport is a pretty good product to pick up. I plan on getting the companion too, but Scarrport is out now. RPGNow Link
This looks interesting. Do you have more information on it? Also, is this in print? I'm not a real big fan of pdf's.

You keep asking which books; there's the setting book, and the books that tailor the setting book to each system... and that's about it. Unless you want the adventures. There's plenty of adventures set in Freeport.

There aren't any additional setting elements, though. There's Pirates Guide to Freeport and that's about it.

It's a great book, by the way. I bought it at GenCon 2007 when (I think) it was still really new, and it's one of my favorite little mini-settings out there.

Oh, yeah... Cults. I forgot about that one, which is kinda embarassing because I have it.

Still, though... that's gravy. Unless you intend to focus on the cults as antagonists, I'd just get the main setting book and start from there.
 

Also, Warriors & Warlocks has a chapter on Freeport, with stats for NPCs & stuff. The chapter is essentially the M&M/W&W Freeport Companion.
