GenCon files Chapter 11

I can't speak for the other two, but GenCon Australia is a lisencee rather than a convention directly controlled by Gen Con LLC. It's funded by a local Australian company and run by a local team of organisers, so it shouldn't be affected by this too much.

Friends and gamers, here are some comments on the thread so far.

Words of encouragement: Thank you, I appreciate the support! For me, sure, but most importantly, for Gen Con. It's a critical element of our hobby and as a fellow fan for years before I acquired it it has my undying loyalty and deserves our best.

Words of critique: These are well deserved. I readily acknowlege that as CEO I am ultimately responsible for all the decisions that led to this point and this criticism is well-founded. I have often run Gen Con more like a hobby than a business, just trying to create the best show I could without necessarily trying to make a profit. Providing that the business was trending in the right direction I knew eventually the profit would come. When Gen Con So Cal stopped growing and was still losing money I closed it, but Gen Con Indy is great, growing, and until recently I was willing to put all the profits back into growth. Btw, I don't get a salary running Gen Con, so the comment about me making millions on this is incorrect. Now we have a different situation and we need to run the business to make profit so we can pay back these debts. Gen Con Indy will be great but we are running it a bit more "tightly." I'm not sure if attendees will notice anything different, most of the cut-backs were in being less generous with businesses we deal with and such. In the past when we hit a snag I simply put more money into the business personally, but right now all my non-Gen Con personal wealth is tied up in Hidden City Games to build Bella Sara, a beautiful brand whose messages of how to live a positive life are impacting the lives of millions of young girls around the world. My personal interests are completely meaningless in comparison. So when we ran "that other show" this year where every single revenue line was down versus forecast (for example, sponsorship revenue was forecasted at $500,000 and came in at $20,000) it was a disaster. And, you're right, that was definitely not a high-performance mark in my career. So I fired myself. That's why Adrian Swartout is running Gen Con now as president and I'm just the figurehead! My direction to her was simple, scale back the business and quit trying to grow by doing all these other shows and stuff (we also had a big website initiative we were working on, but that idea has moved over to Hidden City Games). Let's just scale back and run Gen Con Indy as efficiently as possible so we can pay everyone off.

The charity situation: This is our top priority creditor and will most certainly get paid. We offered a solution to one of the companies suing us that would have had them paid fully by now but that settlement offer was ignored. I'm sorry I can't say more.

But, maybe someone sat on the money, absconded with the money, or told the bosses that everything was "all good" right up until they got the letter from Lucas?

That is so true....

I am very curious as to what is said in their Creditors Meeting. That is where they are asked questions about the debts and their side will be told.

I worked in Bankruptcy Law for the debtors for 2 years, and every client I have worked with say that the Creditors Meeting is the toughest part, because when they answer the questions about the debt from the Trustee of the case, they can also be asked questions by the creditors and their attorneys. I am fairly certian that Lucas' attorneys will not only be there but will also grill them about everything regarding the debts to MAW and Lucas films.

I really don't think they regret selling it. They have winter fantasy and do not have to comit a whole lot of money into a project that doesn't soley support them.

Gen Con 08 will happen. The bankruptcy essentially insulates the company from the Lucasfilm lawsuit and other creditors. It forces them to sit down and negotiate a settlement in bankruptcy court instead of tearing the company apart with lawsuits.

Furthermore, the creditors will realize that Gen Con 08 being a profitable success can only benefit them since it means more money in the coffers of the company that can be used to pay them back per the court's bankruptcy restructuring.
 

Well, certainly enough doom going around.

GenCon is very profitable, this is why they decided to expand further into the convention business. The convention business is NOT an easy road. Someone last fall told me that GenCon makes $, two of the other conventions they run "almost" break even, and everything else is simply a toilet they use to flush away the money they make at GenCon. I don't know how much of that is true, but some of it must be. I guess they have been flushing down money they didn't have yet...

If you are running a business and you are facing a potential lawsuit or debt claim that can lock your assets and put you out of business you OWE it to your employees to do everything you can to keep going. GenCon '08 (Indy) looks like the big ticket for them, it'll either pull their behind out of the fire and allow them to keep going, or it, well, won't. In order to run GenCon '08 they need to be able to pay employees and keep working on it.

GenCon Indy will still go on, it is in the best interest of everyone involved, GenCon LLC AND the creditors, for it to go on. Horribly simplified comment: a reasonable judge (and most really are reasonable in things like this) will make certain GenCon LLC has the opportunity to run an event that clearly earns profits in order to get creditors the best possible return.
Let's face it though, if you worked for GenCon LLC right now you would have your resume out and be looking for jobs right now. I am guessing they'll lose some of their best staff in the coming months.
I am already registered and going so I am just going to keep a positive attitude about the whole thing.

Wow, this certainly was unexpected news. And like a couple of earlier posters, put me down as someone who read the thread title and wondered why he hadn't seen any of the previous Gen Con files threads since it was up to Chapter 11 already! :lol: :o

In any case, I hope that everything works out ok for ALL parties. I don't want to see a charity get stiffed out of money because of some shifty legal stuff. At the same time, I really don't see Gen Con as going out of its way to be a big evil corporation. It just doesn't make any sense to me.
