If I understand you correctly, then you reinforcing my point. Though there are many reasons to be flat-footed, there is no difference between someone who is flat-footed for whatever reason. Of course there are exceptions, uncanny dodge for example. But baring an exception, if you are flat-footed, it is all mechanically the same.
Likewise, it is my contention that if you can't see someone, for whatever reason, then they are essentially invisible as long as the reasons they can't be seen holds true.

It's a bit like Smite Evil.

As a (Su) ability, it should be a standard action to activate unless otherwise stated.

The effects? "You may attempt to smite evil with one normal melee attack."

So is Smite Evil (Su) a standard action that includes a single melee attack with bonuses, much like using the Manyshot feat is a standard action that includes a single ranged attack with multiple arrows? Or is Smite Evil a non-action that is used to modify a single melee attack you gain from another source, like the Attack, Full Attack, or Charge action, or an AoO?

In practice, I treat it as the non-action. As written, I think it's more correct to consider it a standard action that includes a melee attack, though.

My instinct is that it's not what they intended, but it seems to me that that's what they wrote...
