In the case of reputable heroes, sending the entire party against a meager thief and interrogating him with force and magic would be detestable to anyone observing.
Some people might react that way, but others would cheer them on. Criminals are seldom popular, to put it lightly - well, unless, maybe, the criminal is a member of a Robin Hood-esque group.
